Insurance Claim Rejected? The Escalation Ladder That Works in India

Insurance Claim Rejected? The Escalation Ladder That Works in India

Short answer: a rejected insurance claim is not the end of the matter. Every insurer in India must give you the rejection in writing, with the specific policy clause it relies on. Your escalation ladder is fixed and free: the insurer’s own grievance officer first, then the Insurance Ombudsman (no lawyer, no fee, awards up to ₹50 lakh), with IRDAI’s Bima Bharosa portal running in parallel as a regulatory nudge. A consumer commission remains open on top of all of that. The single most common reason claims fail — alleged non-disclosure on a life policy — cannot even be raised after three years.

General consumer information, not legal advice. Whether a particular rejection stands depends on your policy wording and your medical and payment record.

First: make the insurer put it in writing

A phone call, an SMS or a one-line app notification is not a repudiation. Before you do anything else, get a written rejection letter that names:

  • the exact clause or exclusion being applied, quoted, not paraphrased;
  • the facts the insurer says trigger it;
  • the date of the decision, which starts your clock for the Ombudsman.

Ask for it by email to the grievance address printed on your policy schedule. If the insurer will not name a clause, that itself is the strongest thing you can put in front of the Ombudsman: a repudiation has to rest on something.

The ladder, in order

StepWhereCostTime it should take
1. Grievance Redressal Officer of the insurerEmail address on the policy schedule and the insurer’s websiteFreeAcknowledgement in 3 days; resolution in 15 days
2. Bima Bharosa (IRDAI)bimabharosa.irdai.gov.in, or 155255 / 1800 4254 732FreeIRDAI routes it back to the insurer and tracks the closure
3. Insurance Ombudsmancioins.co.in — 17 centres, chosen by where you live or where the policy was issuedFree, no lawyerAward normally within 3 months of receiving the complete complaint
4. District / State Consumer Commissione-jagriti.gov.inFee by claim value; nil up to ₹5 lakhMonths

Steps 2 and 3 are not alternatives to each other in the sense people assume. Bima Bharosa is a regulatory complaint — IRDAI does not decide your claim, it pushes the insurer to close the grievance properly. The Ombudsman decides, and the award is binding on the insurer.

The Ombudsman: the part most people skip

The Insurance Ombudsman is created by the Insurance Ombudsman Rules, 2017 (amended in 2021, which raised the award limit and widened who may complain). What matters in practice:

  • It is free. No filing fee, no stamp duty, no lawyer. You may appear yourself.
  • Pecuniary limit ₹50 lakh on the award, covering the claim amount and consequential loss. Above that, go to a consumer commission or a civil court instead.
  • Eligibility window: you must have written to the insurer first, and then either received a rejection you are unhappy with, or received nothing for 30 days. File with the Ombudsman within one year of the insurer’s reply (or within one year of the 30 days expiring).
  • Not available if the same dispute is already pending before, or has been decided by, a consumer commission, court or arbitrator.
  • The award binds the insurer, not you. If you accept it, the insurer must comply within 30 days. If you reject it, every other forum is still open.

Complaints are filed online at cioins.co.in or on Form A by post to your territorial Ombudsman. Attach the policy, the claim papers, the rejection letter and your correspondence.

Health claims: the timelines the insurer now owes you

IRDAI’s Master Circular on Health Insurance (2024) put hard clocks on cashless treatment, and these are the numbers to quote when a hospital desk says “we are waiting for the insurer”:

EventObligation on the insurer
Cashless pre-authorisation requestDecision within 1 hour of receiving the request
Final discharge authorisationWithin 3 hours of the hospital’s request
Delay beyond 3 hours at dischargeAdditional hospital charges for the delay are borne by the insurer, not you
Claim repudiationOnly with the approval of the insurer’s Claims Review Committee, with reasons and the policy clause
MoratoriumAfter 60 months of continuous cover, no claim may be contested for non-disclosure or misrepresentation — established fraud excepted

That last row is doing a lot of work and is badly under-used. Five continuous years on a health policy closes the non-disclosure argument for good.

Life claims: section 45 ends the argument at three years

Section 45 of the Insurance Act, 1938 is the most useful provision a life-insurance nominee has. In substance:

  • No life policy may be called in question on any ground whatsoever after three years from the date of issuance, the date of commencement of risk, the date of revival or the date of the rider — whichever is later.
  • Within those three years, the insurer may repudiate for fraud or misstatement only by communicating in writing the grounds and the materials it relies on, to the insured or the nominee.
  • A misstatement that is not fraudulent, on a policy in force for less than three years, does not automatically void the policy — the insurer must refund the premiums paid within 90 days.

So if a life claim is rejected for “non-disclosure of a pre-existing condition” on a policy that has run past its third anniversary, the rejection is bad on its face, and that is a two-line letter to the grievance officer.

Motor claims: the recurring rejections and what actually answers them

Stated reasonWhat to check before you accept it
Driving licence invalid / expiredAn expired licence that is renewable is treated differently from never having held one. Check the renewal grace and the actual licence class for the vehicle.
Delay in intimationIRDAI has repeatedly told insurers that a genuine claim should not be rejected on delayed intimation alone where the delay is explained. Give the explanation in writing.
No FIRRequired for theft and third-party injury. For an own-damage dent, it usually is not — read the clause they cite.
Vehicle used for hire / commercial purposeThe insurer must prove the use, not assert it.
Consumables / depreciation deductionNot a rejection at all — it is a policy-design deduction unless you bought a zero-depreciation add-on. Check the schedule.

What to put in the complaint

Whether you write to the grievance officer or file with the Ombudsman, the same six things carry it:

  1. Policy number, insured name, policy period, sum insured.
  2. One paragraph of facts with dates: what happened, when you intimated, what you submitted.
  3. The rejection letter, and the clause it quotes.
  4. Why the clause does not apply — on the facts, or on the law (section 45, the 60-month moratorium, the Master Circular timelines).
  5. What you want: the claim amount, and any consequential loss you can evidence.
  6. A statement that the matter is not pending before any other forum — the Ombudsman requires this.

Keep it under two pages. The Ombudsman’s office reads a very large number of these.

Frequently asked questions

Can the insurance company reject a claim without giving a reason?

No. A repudiation must be communicated in writing with the grounds on which it is based. For health policies the 2024 Master Circular requires the decision to be cleared by the insurer’s Claims Review Committee and the reason and the policy clause to be stated. A rejection with no identified clause is the easiest kind to overturn.

How much does it cost to go to the Insurance Ombudsman?

Nothing. There is no filing fee and you do not need a lawyer — you may present the complaint yourself, and the Ombudsman may award up to ₹50 lakh. The only conditions are that you complained to the insurer first, that you file within a year of their reply, and that the same dispute is not already before a court or consumer commission.

How long does the insurer have to respond to my grievance?

Acknowledge within three days and resolve within fifteen days of receiving your grievance. If fifteen days pass with no resolution, that silence is itself what opens the door to the Ombudsman after thirty days.

Can a health claim be rejected for a pre-existing disease after several years?

Not after sixty months of continuous coverage. Under the moratorium in IRDAI’s 2024 Master Circular, once a health policy has run continuously for five years, the insurer may no longer contest a claim on grounds of non-disclosure or misrepresentation. Established fraud is the only exception.

Should I go to the Ombudsman or to the consumer court?

Start with the Ombudsman if the amount is within ₹50 lakh: it is free, faster, needs no lawyer, and the award binds the insurer while leaving you free to reject it and go elsewhere. Go to a consumer commission instead if the amount is larger, if you want compensation well beyond the claim, or if you have already rejected an Ombudsman award.

Does complaining to IRDAI get my claim paid?

Indirectly. IRDAI does not adjudicate individual claims — a Bima Bharosa complaint is routed to the insurer with a tracked deadline and counts against the insurer’s grievance record. It is worth filing because it creates pressure and a record, but the forum that can actually order payment is the Ombudsman or a consumer commission.
